Refrigerated vans and ATP certificates: when you need one and what to check before choosing

A guide to checking when ATP may be required for a temperature-controlled delivery van and which documents to review before buying, converting or renting.

A van fitted with refrigeration is not automatically covered by ATP, nor does it on its own meet all food hygiene obligations. Before buying, converting or renting, identify the goods, service and journey, then check that the vehicle’s actual configuration matches a valid certificate.

The short answer: fitted refrigeration does not settle the question on its own

In Spain, ATP rules also apply to transport carried out entirely within national territory. However, the right question is not simply whether the van has refrigeration equipment: you need to establish whether it carries perishable goods covered by ATP, whose transport must take place under controlled temperature conditions and which are specified in the Agreement itself.

A refrigerated van may therefore require ATP, but the need must be assessed on the basis of the goods and the specific operation. For these purposes, Royal Decree 1202/2005 treats both own-account and third-party transport as transport. Delivering products from your own business does not in itself remove the need to check the applicable framework.

In addition, ATP and food hygiene are complementary areas. European hygiene rules require the vehicle compartment, where necessary, to be capable of keeping food at an appropriate temperature and allowing that temperature to be monitored. Having a valid ATP certificate does not replace this food hygiene assessment; nor does having refrigeration automatically prove a specific ATP class.

  • Start by identifying exactly which product will go in the body, rather than relying on the van’s commercial description.
  • Confirm the temperature that must be maintained and for how long, according to the rules applicable to the product and the conditions of your activity.
  • Distinguish between national and international transport: for international ATP transport, loading and unloading take place in different countries.
  • Request documentation before signing a purchase or rental agreement, especially if the vehicle is advertised as insulated, refrigerated or mechanically refrigerated.

What ATP regulates and how it fits with food hygiene

For the national transport of temperature-controlled food, Royal Decree 237/2000 establishes that ATP definitions and rules act as the technical regulation for the construction, inspection and testing of special vehicles, subject to the specific provisions in that Spanish rule. In other words, ATP makes it possible to assess the certified technical suitability of a special transport unit.

The ATP Agreement requires that, for goods in its Annexes 2 and 3 that are subject to it, a unit capable of complying with the specified temperature conditions throughout the transport operation must be selected and used. The unit’s capability is therefore linked to the product and the required temperature, not to whether the compressor starts or the interior feels cold when you view the advert.

Food hygiene adds a functional requirement: where necessary, the compartment must maintain an appropriate temperature and allow it to be monitored. Before deciding on a body type, it is advisable to consult the competent authority or the relevant technical adviser if there is any doubt about the product or service. This guide is intended to organise document checks, not to replace that consultation.

  • Do not confuse a food preservation requirement with a specific ATP class without checking both points.
  • Check that the proposed solution can maintain the temperature throughout the planned journey, including normal delivery operations.
  • Keep the certificate of conformity or certified copy in the vehicle where applicable: for special vehicles registered in Spain that carry temperature-controlled food subject to technical-health regulations within national territory, it must be carried on board.

Insulated, refrigerated and mechanically refrigerated: terms that are not interchangeable

An insulated unit is a body whose insulating walls, including doors, floor and roof, limit heat exchange between the interior and exterior. This definition describes the enclosure and explains why a visual inspection must cover much more than the roof or side panels.

An ATP refrigerated unit is an insulated unit that uses a source of cold other than mechanical or absorption equipment; the Agreement mentions, among other options, eutectic plates, ice or liquefied gases. A mechanically refrigerated unit, by contrast, is an insulated unit fitted with a cold-producing device. These are technical descriptions: they should not be taken as automatically meaning that a particular van can maintain any temperature or has a valid certificate.

The classes of a mechanically refrigerated unit also matter. ATP includes, among others, class A, which allows a temperature to be selected between +12 °C and 0 °C; class B, between +12 °C and −10 °C; and class C, between +12 °C and −20 °C. Do not choose solely on the basis of the advertised minimum temperature without checking the recorded class and the requirement applicable to the goods.

  • Inspect the insulation in the doors, floor and roof, not just the presence of refrigeration equipment.
  • Ask what type of cold source the unit uses and what its documented classification is.
  • Ask the supplier to link the offered configuration in writing to the available certificate.
  • Avoid basing your decision solely on commercial descriptions such as “mechanically refrigerated” or “refrigerated”.

The five questions to answer before choosing a vehicle

A useful purchase starts with your own needs sheet. Record the goods, the temperature that must be maintained, delivery distances and times, whether there will be multiple door openings, and where loading and unloading will take place. Then provide this information to the seller, bodybuilder or rental company and request a documentary answer, not a general promise of refrigeration capability.

The recipient and service model must also be clear. Own-account transport falls within the Spanish definition alongside transport for third parties. If loading and unloading take place in different countries, the assessment must include the international scope of ATP. For a national journey, ATP rules in force in Spain continue to apply to domestic transport.

As a decision rule, reject any unit whose documentation does not allow the specific van, its body and its thermal equipment to be linked to the suitability required by the activity. Then check payload and volume in the final configuration: insulation and equipment are part of the transport solution, not separate accessories.

  • What goods will be carried, and are they within the scope of ATP?
  • What temperature must be maintained throughout the entire operation?
  • Is the service own-account or third-party? Both require assessment.
  • Are loading and unloading carried out in Spain or in different countries?
  • Are the current body, doors and thermal system the ones shown in the documentation?

Documents and physical matches: the check that prevents mistakes

Request the ATP certificate or certificate of conformity and check that it identifies the unit and that its validity date is current. The ATP certification plate may be accepted as equivalent to the certificate if it reproduces the prescribed format, but it cannot be fitted if there is no valid certificate. Do not therefore rely on a partial photograph of a plate or on a statement that the vehicle “used to have ATP”.

It is also advisable to inspect the manufacturer’s plate, which must include the type, serial number, and month and year of manufacture, and compare these details with the certificate. Request the vehicle technical inspection card or technical data sheet (ficha técnica) and, where applicable, the special-unit characteristics sheet (ficha de características). A modification that alters the characteristics of the special vehicle requires a new characteristics sheet and cancellation of the previous one held by the owner.

There is a critical point with used and converted vehicles: repairs or modifications to insulated bodies and thermal devices require a prior favourable report from an inspection body and must be carried out at workshops whose resources and technology have been audited. Changing doors, working on the body or replacing elements of the thermal system without a documented traceability record that preserves conformity is a reason to pause the transaction and request clarification.

  • Manufacturer’s plate: type, serial number, and month and year of manufacture.
  • Vehicle technical inspection card or technical data sheet (ficha técnica) and, where applicable, the special-unit characteristics sheet (ficha de características).
  • Documentation for conversions, repairs or modifications affecting the body or thermal device.
  • For units imported from another ATP contracting party: the test report, ATP certificate and, for series production, the technical specification sheet are among the officially indicated documents.

Buying, converting or renting: settle responsibility before signing

For a new purchase, ask for the offer to identify the exact configuration: vehicle, body, doors and thermal device. For a conversion, agree what documentation will be handed over once the work is completed, and do not treat a change to the body as a simple cosmetic upgrade. When renting, the urgency of deliveries does not justify accepting a van without having seen the documentation for the unit actually being supplied.

ATP conformity inspection is carried out before the unit enters service, periodically at least every six years, and whenever requested by the competent authority. That interval does not allow you to assume that an old certificate is still valid: the date stated on the specific certificate must be checked.

The safest decision is not to buy the van with the most eye-catching refrigeration equipment, but to contract for a certified and documented configuration suited to the planned goods and service. If there is uncertainty over ATP scope or the food hygiene requirements of your activity, consult the competent authority before committing the investment.

  • Include the unit identification, the documents to be supplied and their validity in the order or contract.
  • Physically check the body, doors, floor, roof and thermal equipment against the documents before accepting the vehicle.
  • Do not accept certification for another vehicle, an illegible photograph or a plate unless it is valid for the identified unit and its validity information can be verified.
  • If the vehicle is used, expressly ask about every repair or modification to the body and thermal system.
  • Keep the certificate of conformity or certified copy on board when required.
Do all refrigerated vans need an ATP certificate?

This cannot be answered solely on the basis that they have refrigeration equipment. You must assess whether they carry perishable goods covered by ATP, under controlled temperature conditions and specified in the Agreement, as well as the service conditions and applicable food hygiene rules.

Is own-account delivery outside ATP?

No. Spanish rules treat both own-account operations and third-party operations carried out wholly or partly within national territory as transport.

Is an ATP plate enough if I do not have the certificate?

An ATP certification plate may be equivalent to the certificate of conformity if it reproduces the prescribed format, but it may only be fitted where a valid certificate exists. Always check the identification and validity date.

What happens if I modify the body or refrigeration equipment?

Repairs or modifications to insulated bodies and thermal devices require a prior favourable report from an inspection body and must be performed at workshops with audited resources and technology. If the characteristics of the special vehicle are altered, a new special-unit characteristics sheet (ficha de características) must be issued.

How often is ATP conformity checked?

The ATP Agreement establishes checks before a unit enters service, periodically at least every six years, and whenever required by the competent authority. Always verify the validity date on the certificate for the specific unit.
